Legal Conditions/ Terms


FLATS RESERVATION APARTMENTS IN MADRID:


• To be able to confirm your Reservation it is necessary that clients deposits the amount indicated in the reservation request and which will depend on the chosen apartment, number of persons and during of the stay. The reservation deposit will have to be made by credit card.

• The reservation only will be accepted and confirmed when Gavirental receives the reservation deposit and the client receives a confirmation e-mail of the reservation.


• The deposit will be 25 % of the total amount of the price of the apartment, according to the number of persons and the during of the stay. The deposit will have to be paid by credit card.


• The rest of the price of the reserved apartment will have to be subscribed in cash by the client at the arrival to the apartment. Payments with credit cards have 3% of surcharge.Payments by bank transfer are accepted as long as  the cost of the same one is at the expense of the client.


• For reservations of stays from 3 to 6 days and those made for high season dates, it will be possible to request the complete payment of the price of the stay in the moment to made the reservation.


• In reservations made with a minimal anticipation of seven days, it will be possible to requested to the client the complete payment of the price of the stay.


(It can also be reserved by printing our reservations form and sending it by fax to the following number: (+34) 914.119.207. Likewise, you can call us during the office schedule and we will take the information by telephone. In case of sending your personal data, all the information will be transferred across a safety servant to guarantee your privacy.)


For stays of weeks or months in any of our apartments, please consult us. We will study your needs and we will offer you better prices.
• IMPORTANT: For a better attention of our personnel, the client will have to send by e-mail the approximate hour of arrival to the reserved apartment. Once in Madrid, the client will have to confirm the hour of arrival to the apartment calling to the contact phone number indicated to him in the e-mail.

CANCELLATION OF confirmed RESERVATIONS


In case of annulment or cancellation of the confirmed reservation, when the client had paid the totality of the price of the apartment, if the cancellation is produced before his arrival to the apartment. Gavirental, will retain from the total amount paid by the client the following quantities as expenses of cancellation:

- 25 % of the total solvent amount if the cancellation takes place with 75 days or more of anticipation to the foreseen date of entry to the apartment.
- 35 % of the total solvent amount if the cancellation takes place from 60 to 75 days of anticipation to the foreseen date of entry to the apartment.
- 50 % of retention of the total solvent amount if the cancellation takes place from 30 to 60 days of anticipation to the foreseen date of entry to the apartment.
- 100 % of retention of the total solvent amount if the cancellation takes is produced with less than 30 days of anticipation to the foreseen date of entry to the apartment.

• The deposit carried out to reserve the apartment will not be reimbursed to the client in case the reservation is annulled or cancelled, charging to this amount expenses of cancellation.

• The change of reserved apartment or the change of dates for an already reserved apartment will be able to be considered as a cancellation of the previous reservation

APARTMENT ARRIVAL:


• 75% of the remaining price of the reserved apartment will have to subscribed to Gavirental in cash at the arrival to the reserved apartment. The apartment will not be submitted if the rest of the payment is not be made in cash.


• When the client comes to the apartment it(he,she) will have to deliver the Warehouse(Deposit) of Guarantee to Gavirental. The quantity to deposit will depend on the apartment and time of reserved stay and will range between 200 and 1.000 Euros. This Warehouse(Deposit) of Guarantee will be returned to the client when it(he,she) finishes his(her,your) stay and there is verified by Gavirental that the apartment is in the same condition(state) in which it(he) him(her) was dedicated. The Warehouse(Deposit) of Guarantee answers of the hurts(damages) and deteriorations that should take place(be produced) in the apartment during the stay of the client and that should be repaired


• In any case the client will have to have paid the totality of the price of the reserved apartment before this one is rented..

• In the supposition that the reserved apartment could not be available for any reason, Gavirental promises to deliver another apartment of similar or top characteristics inside the same locality. If the client was not consent to this change Gavirental he will return him all the payments carried out before the entry in the apartment. The client will not be able to request either any type of indemnification nor compensation for the change of the apartment..

SCHEDULE OF entries AND EXITS OF THE APARTMENTS:

• Gavirental's personnel will deliver the apartment to the client at the foreseen hour. Before the entry to the apartment the client will have to sign a temporary rent contract for the reserved apartment, pay the rest of the established fare and deposit the corresponding guarantee amount. Payments will have to be made in Euros. Our personnel will show the reserved apartment to the client and will give him the keys of it. The apartment will be clean and in perfect conditions of use.

• Entrance hour to the apartments: From 15:00 (pm). If the client wants to enter to the apartment reserved before this hour he will have to request it to Gavirental by e-mail.

• Entries to the apartments after 20:00 until 24:00, will have an additional charge of 30 Euros, like entries produced in Sundays and festive. Entries after 24:00 will have an additional charge of 50 Euros

• Exit hour of the apartments: Before 11.00 hours (am). If the client wants to go out of the apartment after this hour , he will have to request it to Gavirental's personnel. Exits after 11.00 hours will have an additional charge of 50 Euros.

• Exits of the apartment before 09:00 have an additional charge of 30 Euros.


Cleanliness


The apartments will be submitted in perfect conditions of use and cleanliness. In established day of exit, the client must leave the apartment in the same terseness in which he received it.

If you wish to hire extra cleaning service, the cost  of the same is 50€ paid in cash.


In case the apartment was excessively dirty, Gavirental will be able to deduce of the Deposit of Guarantee the necessary amount to realize the corresponding cleanliness.

RULES OF USE OF THE APARTMENTS

The reserved apartment only can be used as temporary housing by the time previously paid by the client. In any case it can be used as habitual housing by none of the occupants of the apartment.


It is prohibited to clients to sublease the apartment and the partial or total transfer of it. In the reserved apartment you cannot develop any type of commercial activity. Likewise it is prohibited to realize immoral, troublesome, unhealthy activities prohibited by the law.

Rules of Behavior

1. Hours of silence: Monday to Friday from 22:00 to 9:00 h Saturday to Sunday from 00:00 to 10:00h. It is not allowed to organize parties in the apartments. Support the TV and the music in a normal tone.
2. Extinguish the air conditioning and the lights when you go out of the apartment.
3. The garbage will have to be settle from 20:00 in the containers you can find in the exterior of the building.
4. The reserved apartment only will be able to be inhabited by the persons indicated in the reservation.
5. Support the apartment in perfect conditions. The cost of any break or damage in the furniture or chattels of the apartment caused by any occupant of the apartment will be discounted of the Guarantee Deposit.
6. If by the behavior of any of the occupants of the apartment there was produced some controversy of public order, Gavirental saves itself the right to remove the apartment of all the occupants. In this case, the client will either not have the right to the return of the Guarantee Deposit, nor to the return of any quantity for any concept, even the term of occupation is posterior.
7. Do not throw wastes, garbage or any other objects to the water closet
8. It is not permitted to change the furniture of the apartments.

Responsabilities

Gavirental is not responsible for the direct or indirect losses that could be caused by the occupants of the apartment during their stay and that could be produced, by natural catastrophes, losses and fire damages, thefts or any other type of criminal contingency.

The use of the services of this page implies the agreement and the acceptance of the above mentioned terms and conditions and its future changes carried out before the stay in the apartment. These conditions do not concern the statuesque rights of the user.

Renting contract


The contract that the client will sign with Gavirental is a Temporary Rent of Apartments Furnished contract in conformity with the Spanish Legislation, Law 28/1994, of Urban Leases, to the civil legislation that turns out to be supplementary and to the Law 1/2000, of Civil Prosecution, with competition of the Courts of Madrid, Spain. These season contracts do not allow that the apartments should be rented as habitual or permanent residence. Only the rents are allowed by short periods of time by trips, vacations, studies, temporary stays, etc.
In the moment of the entry to the reserved apartment, the client will sign an inventory of the furniture and chattels with which it counts and will be verified in the delivery of the keys at the exit.

In case of any violation of the obligations mentioned above, Gavirental saves itself the right to request the eviction of the apartment of the client and this one will have not right either to any economic compensation nor refund of any quantity.
